Terms of service
These Terms of Sale govern all purchases from bioconfetti.com.au, operated by Blaso Pty Ltd (ABN 67 623 139 104), trading as Bioonfetti Australia, of 23 Dawson Street, Coburg North VIC 3058 ("BioConfetti Australia", "we", "us"). By placing an order you agree to these terms. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (ACL) or other legislation that cannot lawfully be excluded.
1. Orders and acceptance
All orders are offers to purchase and are subject to acceptance by us. We may decline or cancel an order (including for pricing or stock errors, suspected fraud, or dangerous-goods delivery restrictions); if payment has been taken for an order we cannot accept, it will be refunded in full. A contract is formed when we confirm dispatch of your order.
2. Prices and payment
Retail prices on the website are in Australian dollars and include GST unless stated otherwise. Delivery charges are additional and shown at checkout. Prices may change without notice, but changes don't affect orders already accepted. Payment is due at the time of ordering through the payment methods offered at checkout. For approved trade accounts, pricing and payment terms are as set out in our Trade Terms.
3. Delivery and risk
Delivery is per our Shipping Policy. Delivery times are estimates made in good faith. Risk in the goods passes to you on delivery to your nominated address (or on collection, for warehouse pickups). Title in the goods passes when payment is received in full.
4. Dangerous goods and safe use
Some products are classified as dangerous goods and are sold subject to our Dangerous Goods & Safety terms, including road-freight-only shipping within Australia and purchaser age requirements. You are responsible for using all products in accordance with the supplied instructions and applicable laws and venue requirements.
5. Professional equipment
Certain equipment we supply (including electric cannon systems and installation hardware) is intended for use by trained or professional users. You must ensure such equipment is operated by competent persons in accordance with its instructions. To the extent permitted by law (and without limiting your ACL rights), we are not liable for loss arising from misuse of products or use contrary to instructions.
6. Returns and remedies
Returns, refunds and your ACL rights are set out in our Refund Policy, which forms part of these terms.
7. Warranty
Equipment (excluding consumables such as cannons, confetti, streamers and fluids) is warranted against defects for 12 months from the invoice date, in addition to — not instead of — your ACL rights. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law; the benefits of this warranty are in addition to other rights and remedies you have under law. To claim, contact sales@bioconfetti.com.au with your order number and a description of the fault.
8. Liability
To the extent permitted by law, and subject always to your ACL rights: our liability for any claim arising out of a sale is limited, at our option, to replacement or resupply of the goods or payment of the cost of replacement; and we are not liable for indirect or consequential loss. Where liability cannot be excluded but can be limited, it is limited to the fullest extent permitted.
9. Website content and intellectual property
Content on this website (including images, copy and branding) is owned by or licensed to Blaso Pty Ltd and may not be reproduced without permission. Product information is provided in good faith; we may correct errors in descriptions, pricing or availability, and where an error materially affects an order you'll be offered a correction or full refund. Colours may display differently on different screens.
10. Privacy
Your personal information is handled in accordance with our Privacy Policy.
11. Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier failures, supplier failures, government action or natural events. If such an event continues for an extended period, either party may cancel affected orders and we will refund amounts paid for undelivered goods.
12. General
If any provision of these terms is void or unenforceable, it is severed and the remainder continues in force. These terms are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of its courts. We may update these terms from time to time; the version published at the time of your order applies to that order.
